NEWPORT, Vermont— Chief Seth C. DiSanto reports that the Newport Police Department has charged a man with DUI after locating his vehicle stopped facing the wrong direction on I-91 yesterday.
JUSTIN GABORIAULT, 28, of BROWNINGTON, VERMONT has been charged with:
- Driving Under the Influence Criminal Refusal
- Gross Negligent Operation
- Reckless Endangerment
At approximately 4:22 a.m. on Sunday, Feb. 23, Newport Police responded to a report of a vehicle facing the wrong direction at mile marker 175 on I-91. Upon arrival, Newport Police found two Border Patrol units at the scene, as well as a Chevrolet truck which was facing north on the southbound shoulder section of I-91.
Border Patrol Agents on scene advised Newport Police that attempts to wake the driver of the truck, GABORIAULT, had been unsuccessful. Newport Police were able to wake GABORIAULT, who was sitting in the driver’s seat with the engine running. GABORIAULT, who allegedly appeared disoriented, smelled of intoxicants and had bloodshot and watery eyes, declined transportation to an area hospital.
Newport Police did not conduct Field Sobriety Tests on the side of the interstate due to safety concerns, and GABORIAULT was transported to the Newport Police Department to further the investigation.
GABORIAULT subsequently submitted to and ultimately failed multiple sobriety tests at the Newport Police Station. GABORIAULT also declined to take a preliminary breath test.
GABORIAULT was held overnight at the Northern State Correctional Facility in Newport on $2,500 bail and is expected to be arraigned on Monday at Orleans County Superior Court.
These are allegations. All suspects are innocent until proven guilty.
